Identify The Wage Issue
Unpaid wages disputes can involve missing pay, incorrect hours, unauthorised deductions, commission, bonus, notice pay, holiday pay, expenses or final salary. The first enquiry should identify the exact payment being disputed and the period it covers.
Employment tribunal, county court and internal grievance routes may have different rules and deadlines. This guide is preparation information only.
- Type of payment in dispute, such as salary, hourly pay, overtime, commission or notice pay.
- Dates and pay periods affected.
- Whether ACAS early conciliation, a grievance or a tribunal claim has started.
- Any dismissal, discrimination, whistleblowing or settlement agreement overlap.
Documents To Gather
A barrister will usually need the documents that show what was agreed, what work was done, what was paid and why the employer says the deduction or shortfall happened.
- Employment contract, offer letter, staff handbook and pay policy.
- Payslips, P60, P45, payroll records and bank statements showing payments received.
- Timesheets, rota, clock-in records, commission statements or bonus calculations.
- Letters or emails explaining deductions, adjustments or repayment demands.
- Grievance, appeal, ACAS early conciliation and tribunal documents.
- A short calculation of the amount claimed and how it was worked out.
