Short answer
Prepare the contract, notice provisions, dismissal letter, payslips, disciplinary or redundancy procedure, appeal papers, ACAS dates, tribunal or court papers and a short chronology before requesting a quote.
Quick checklist
Start with these
Best order
How to organise the first pack
- Put the contract and notice clause first.
- Add the dismissal letter, final payslip and termination date.
- Separate contractual issues from unfair dismissal or discrimination points.
- List ACAS, tribunal, county court and appeal dates clearly.
- State whether advice, drafting, negotiation or advocacy is requested.
Start With The Contractual Issue
Wrongful dismissal usually concerns whether the employer breached the employment contract. It may involve notice pay, payment in lieu of notice, summary dismissal, garden leave, restrictive covenants or a contractual disciplinary or redundancy procedure.
The first enquiry should separate the contractual complaint from any unfair dismissal, discrimination, whistleblowing or unpaid wages issue. Those claims may have different tests, remedies and deadlines.
- Employment contract, handbook and any variations.
- Notice clause, payment in lieu wording and bonus or commission terms.
- Dismissal letter, termination date and final payslip.
- Disciplinary, redundancy, capability or grievance papers.
- Appeal letter, outcome and any settlement correspondence.
Evidence For Loss And Procedure
A barrister will usually need both the contract papers and evidence showing what actually happened. A short chronology should identify when notice was given, whether pay was made and what steps were taken before dismissal.
- Payslips, P45, holiday pay and final payment records.
- Emails or meeting notes about dismissal, notice or resignation.
- Evidence about contractual benefits, commission, bonus or pension loss.
- ACAS early conciliation certificate or dates if tribunal issues are in play.
- Claim form, response, particulars, defence or hearing notice if proceedings have started.
Scoping The Barrister Quote
A focused request might ask for initial advice on the contract, drafting a letter before claim, reviewing a settlement offer, preparing tribunal or county court pleadings, or representation at a suitable hearing.
Some matters need solicitor support for correspondence, disclosure, filing, service or ongoing litigation conduct. The barrister or chambers should confirm whether Direct Access is suitable.
Avoid delays
What not to send first
- Using wrongful dismissal and unfair dismissal as if they are the same claim.
- Leaving out the contract or notice wording.
- Assuming a quote request protects any limitation or tribunal deadline.
- Sending only a narrative without pay and dismissal documents.
Source/review note: checked against Acas dismissal guidance and GOV.UK employment tribunal guidance on 7 September 2026. Wrongful dismissal, unfair dismissal, breach of contract, tribunal jurisdiction and limitation wording need specialist employment review before publication.

Wrongful Dismissal Barrister Documents Checklist FAQs
Is wrongful dismissal the same as unfair dismissal?
Not usually. Acas describes wrongful dismissal as a contract breach issue, often involving notice or notice pay, while unfair dismissal involves different statutory questions.
Can a barrister advise before a claim is issued?
A barrister may advise on the contract, evidence, settlement position, pleadings or representation where the work can be properly scoped and Direct Access is suitable.
Does a quote request pause employment deadlines?
No. Include the dismissal date, ACAS dates and any tribunal or court deadline in the enquiry, but do not assume time stops running.
