Best order
How to organise the first pack
- Put the court stage and hearing date first.
- Add a one-page monthly budget and income summary.
- Group bank, income and expense evidence by month.
- Explain what interim order or advice is being requested.
Start With The Court Stage
Identify whether divorce, dissolution, nullity, judicial separation or financial remedy proceedings have started. Include any Form A, D11, orders, directions, hearing notices and online filing confirmation.
Family Procedure Rules Part 9 includes applications for maintenance pending suit, maintenance pending outcome and other interim orders. If a hearing is listed, place the date at the top of the enquiry.
- Form A, D11, application notice and supporting statement if prepared.
- Divorce or dissolution stage and any conditional or final order.
- Existing financial remedy orders, directions and hearing notices.
- Service evidence, response dates and correspondence with the other party.
- Any linked legal services payment or interim variation request.
Show Need And Means
The first bundle should explain present income, outgoings, shortfall and known resources. Include difficult facts, such as disputed spending, available savings, changed work, debt or support from family.
If financial statements have not yet been filed, current information is especially important. A barrister needs enough material to see what is known, what is missing and what is urgent.
- Payslips, accounts, benefit or pension income and tax documents.
- Bank statements, rent or mortgage, bills, childcare and essential expenses.
- Budget, arrears, debts, school fees, insurance and support payments.
- Known respondent income, business interests, lifestyle or disclosure.
- Offers, without-prejudice material clearly labelled, and settlement history.
Define The Barrister Task
A barrister may be asked to advise on evidence, draft or review a statement, prepare submissions, consider settlement or represent at a suitable interim hearing.
Some cases need solicitor support for filing, service, disclosure, implementation, enforcement or ongoing correspondence.
Avoid delays
What not to send first
- Sending a budget without income evidence.
- Leaving out the court stage or hearing date.
- Mixing final settlement points with urgent interim needs.
- Assuming a quote request files the application.
Source note: source-checked against Family Procedure Rules Part 9, Practice Direction 9A and HMCTS MyHMCTS financial remedy guidance on 23 September 2026. Interim maintenance merits, needs, means, costs, legal services payment and disclosure issues need specialist family finance review.

Maintenance Pending Suit Barrister Evidence Guide FAQs
What is the first evidence for maintenance pending suit?
Send the financial remedy application stage, income evidence, bank statements, household budget, urgent need, known respondent income and any hearing or response date.
Can one statement cover interim maintenance and legal services payment?
Practice Direction 9A says evidence may be contained in one witness statement where those applications are made at the same time, but the correct content needs case-specific review.
Does asking for a quote make an interim application?
No. A quote request does not file Form A, D11, evidence, service documents or any court application.
