Identify The Stage Of The Financial Remedy Case
Spousal maintenance may arise during divorce, dissolution, separation, consent order negotiations, contested financial remedy proceedings, variation or enforcement. The first request should say whether proceedings have started and what order or proposal is being considered.
If there is a hearing date, directions order, Form A, Form E, D81 statement or draft consent order, put those papers at the front of the pack.

Maintenance issues often depend on income, earning capacity, outgoings, housing needs, child arrangements and financial disclosure. The pack should show the figures relied on by each side and where there is disagreement.
- Payslips, accounts, tax returns, benefits, pension and bank statements.
- Monthly budget, mortgage or rent evidence and household bills.
- Child maintenance information and childcare costs if relevant.
- Medical, caring, disability or employment evidence affecting earning capacity.
- Schedule of arrears, payment history or proposed variation.
What A Barrister May Be Asked To Do
