Start With The Order And Requested Change
Put the sealed financial order, consent order or maintenance order at the front. Highlight the clause or payment that is being varied, suspended, discharged, enforced or clarified.
- Sealed order, recital, schedule and any pension annex.
- Application notice, draft Form D11 or draft order if prepared.
- Reason for the requested change and date circumstances changed.
- Arrears schedule, payment history or enforcement history.
- Next hearing, filing or response deadline.
Show The Current Financial Position
Variation disputes often depend on up-to-date finances rather than the position when the original order was made. Put documents in date order and separate agreed figures from disputed figures.
- Payslips, accounts, benefits, pension and tax evidence.
- Mortgage, rent, childcare, care, travel and household budget evidence.
- Bank statements, debts, savings and asset valuation material.
- Evidence about redundancy, illness, business change or caring responsibility.
- Any disclosure requests, replies or missing documents.
Separate Variation From Enforcement
The enquiry should explain whether the immediate issue is changing future payments, dealing with arrears, enforcing the existing order or responding to an enforcement application.
- Enforcement application, judgment summons, order to attend or attachment documents.
- Correspondence about missed payments, affordability or proposals.
- Open offers and without-prejudice material clearly separated.
- Any linked divorce, child maintenance or property proceedings.
- The specific work requested: advice, drafting, negotiation support or advocacy.
