How to organise the first pack

  1. Start with a one-page chronology covering the proposed or completed transfer, consultation dates and any dismissal or contract-change dates.
  2. Put commercial transfer, outsourcing, retendering or insourcing documents in a separate section from employee consultation papers.
  3. Mark the precise question for the barrister, such as whether TUPE may apply, how to respond to a claim, or what evidence is missing.

Explain The Transfer Clearly

A TUPE review depends on the facts. Say whether the matter concerns a business sale, outsourcing, insourcing, retendering or another service provision change. Include the old provider, new provider, client organisation, affected teams and proposed or actual transfer date.
