Prepare title documents, transfer or conveyance wording, plans, photographs, access history, correspondence and any urgent works or court dates.
Quick checklist
Start with these
Start With The Land Documents
A right of way may depend on express wording, implied rights, prescription, leases, transfers or practical context. Send the title register, title plan, transfer, conveyance, lease or any document that grants or describes the access route.
Show The Route Clearly
Plans and photographs help a barrister understand the physical issue. Mark the claimed route, obstruction, gate, parking area, track, shared drive or disputed width. Avoid altering original evidence; keep a clean copy and a marked copy.
Evidence Of Use And Obstruction
Historic and current use may matter. Put evidence in date order and explain whether the route has changed, been blocked, narrowed, gated or used differently.
- Photographs before and after the obstruction.
- Messages, letters and notices from neighbours, freeholders or managing agents.
- Delivery, maintenance, access or business-use records where relevant.
- Witness notes from people who know the route history.
- Surveyor, expert or Land Registry correspondence if available.
Urgency And Remedies
Say whether there is a threatened building work, locked gate, blocked business access, sale, injunction application or hearing date. A barrister can only assess urgency if dates and consequences are explained clearly.
Review Notes
Rights of way and easements are fact-sensitive. HM Land Registry documents, current court procedure and any expert survey evidence should be reviewed before adding conclusions about enforceability or remedies.
Editorial status: source and legal review required. No completed legal review is claimed.
Right Of Way Dispute Barrister Evidence Guide FAQs
Can a barrister advise from Land Registry documents?
A barrister may advise from title documents and supporting evidence, but many cases also need plans, photographs, correspondence and sometimes expert input.
What if access has been blocked suddenly?
Include the date, photographs, impact, title documents and any threatened works or hearing date. Urgent help depends on availability and suitability.
Is this legal advice about my right of way?
No. This guide is general information. A conclusion about a particular right of way needs review of the documents and facts.
