How to organise the first pack

Identify The Order, Deadline And Sanction
A barrister needs the precise order, rule, direction or unless order said to have been breached. Put the deadline and the date of default at the front of the pack.
If an application has already been issued, include the application notice, witness statement, draft order and listing notice.

Explain The Default And Response
The chronology should be short, dated and evidenced. It should show what happened before the deadline, when the default was noticed, and what steps were then taken.
Avoid advocacy labels in the evidence bundle. Separate facts, documents and requested submissions so the advice can be focused.
- Reason for default, supported by documents where possible.
- When the party became aware of the problem.
- Steps taken to remedy the default.
- Impact on trial, hearing dates, evidence and the other party.
- Any previous extensions, defaults or unless orders.
Urgency And Scope
A relief application may need prompt action. The quote request should state whether advice, drafting or advocacy is needed and whether court papers must be filed within a fixed time.
