Short answer
Prepare the inspection report or draft report, complaint form, provider correspondence, school or setting complaint history, safeguarding context, evidence pack, deadlines and outcome sought.
Quick checklist

Best order
How to organise the first pack
- Put the inspection or complaint decision first.
- Create a table matching each disputed point to evidence.
- Separate Ofsted-process issues from school/provider complaint issues.
- Flag publication, escalation and safeguarding dates.
Identify The Complaint Route
Start by explaining whether the complaint is by a school, childcare provider, social care provider, parent, staff member or another person affected by an Ofsted process.
The evidence needed differs depending on whether the issue is a complaint about Ofsted's inspection activity, a complaint about a provider Ofsted inspects or a wider school complaint.
- Inspection notification, draft report, final report or monitoring letter.
- Complaint form, acknowledgement, Ofsted response and escalation papers.
- Provider complaint policy and school or setting responses if relevant.
- Evidence bundle, policy documents, minutes, safeguarding records or witness notes.
- Publication date, response deadline, ICASO step or judicial review concern.
- Any immediate safeguarding or welfare issue and who has been notified.
Match Evidence To The Disputed Finding
A useful pack links each disputed inspection point to the document, event or witness evidence said to answer it. Separate disagreements about judgement from factual accuracy, process fairness, safeguarding, complaints route and remedy.
If the complaint is about a state school rather than Ofsted's own conduct, include evidence that the school complaints process has been followed and why Ofsted or another body is being contacted.
Define The Legal Work Needed
A barrister may advise on evidence, complaint drafting, public-law fairness, urgent publication concerns, written representations or a defined hearing where Direct Access is suitable.
Some cases need solicitor support for pre-action correspondence, judicial review, disclosure, safeguarding referrals, media issues or ongoing regulator contact.
Avoid delays
What not to send first
- Sending a long narrative without the report or complaint response.
- Mixing individual school complaints with Ofsted inspection complaints.
- Leaving out safeguarding referrals or urgent welfare context.
- Assuming a quote request pauses publication or submits a complaint.
Source note: source-checked against Ofsted and GOV.UK complaints procedure guidance on 23 September 2026. Inspection complaints, provider complaints, school complaints, safeguarding referrals, judicial review and publication issues need specialist education or public-law review.
Claim and official-source ledger
- Ofsted complaints guidance says the first step for complaints about a provider Ofsted inspects or regulates is usually to raise issues through the provider's full complaints procedure.
- Complaints procedure - Ofsted — GOV.UK; checked .
- GOV.UK guidance says Ofsted considers complaints about things that affect the whole school rather than individual issues and that complaining to Ofsted does not mean it will inspect the school.

Ofsted Complaint Barrister Evidence Guide FAQs
What should a school or provider send first?
Send the inspection notification, draft or final report, complaint submission, Ofsted response, evidence relied on, timeline and any publication or escalation deadline.
Can Ofsted resolve individual school disputes?
GOV.UK guidance says Ofsted considers complaints about things that affect the whole school rather than individual issues, and cannot change the outcome of a school complaint.
Does a quote request submit an Ofsted complaint?
No. A quote request does not submit a complaint, extend a complaints deadline, pause publication or start court proceedings.
