Best order
How to organise the first pack
- Place the decision letter and appeal rights page at the front.
- Add the date received, method of service and any stated deadline.
- Include the original application bundle and evidence relied on.
- Add a short immigration history and the specific help requested.
Start With The Decision Being Challenged
Immigration routes differ. Some decisions may carry appeal rights, some may involve administrative review, and some may raise judicial review or reconsideration questions. A barrister needs the actual decision letter before discussing the possible route.
Do not rely on a summary of the refusal. Include the full reasons, date, appeal rights section and any Home Office or tribunal reference numbers.
Documents To Send With A Refusal Enquiry
The first pack should explain what was applied for, why it was refused and what evidence already exists.
- Home Office refusal letter, review decision or tribunal decision.
- Appeal form, administrative review request, grounds or tribunal directions if already filed.
- Original application form, cover letter, evidence bundle and payment or submission confirmation.
- Passport, BRP, eVisa, previous leave or immigration history documents where relevant.
- Witness, family, employer, sponsor, medical, financial or country evidence relied on.
- Any removal, detention, bail, reporting or urgent correspondence.
Define The Work Requested
A barrister may be asked for defined advice on the decision, evidence gaps, grounds, written submissions or hearing representation where Direct Access is suitable.
Some immigration matters require a solicitor or regulated immigration adviser for ongoing management, filing, service, legal aid, interpreter arrangements or Home Office correspondence. The suitability decision should be made after the papers are reviewed.
Review Notes For Appeal Routes
Appeal rights, deadlines, fees, urgent applications and review routes can change and depend on the decision type. Current GOV.UK, HMCTS and tribunal guidance should be checked before publication or any case-specific step.
Avoid delays
What not to send first
- Sending only the refusal headline without the full reasons.
- Omitting the date received or the appeal rights section.
- Mixing several immigration routes without a chronology.
- Assuming a quote request extends an appeal, review or tribunal deadline.
Source/review note: current GOV.UK immigration appeal, administrative review and HMCTS tribunal guidance should be checked before publication.
Editorial status: source and legal review required. No completed legal review is claimed.
Immigration Appeal Refusal Decision Barrister Checklist FAQs
Can a barrister advise after an immigration refusal?
A barrister may advise on a refusal, evidence, grounds or representation where the papers show that the work is suitable for Direct Access.
What if the refusal says there is no right of appeal?
Send the full decision letter. A barrister or other authorised adviser may need to consider whether review, reconsideration or another route is relevant, but this is fact-specific.
Does requesting a quote protect my immigration deadline?
No. A quote request does not pause or extend Home Office, appeal, review or tribunal deadlines.
