Financial remedy advice is most useful when the barrister can see the assets, the disputed issues, the stage of proceedings and any deadline or hearing date.
Tell the barrister whether divorce proceedings have started, whether a financial remedy application has been issued and whether any hearing is listed. The work needed for early advice is different from representation at an FDA, FDR or final hearing.
If there are urgent deadlines for Form E, questionnaires, valuations or statements, include those dates at the start of your enquiry.
A barrister does not always need every bank statement at the first stage, but they do need enough information to understand the assets, liabilities, income and main areas of dispute.
If Form E has already been exchanged, include it. If not, provide a clear summary of property, savings, pensions, businesses, debts, income and any known disclosure concerns.
A family barrister may advise on settlement range, evidence gaps, disclosure, pensions, business assets, maintenance, lump sums and the risks of rejecting or accepting an offer.
They may also help with drafting, position statements or representation at a listed hearing where the matter is suitable for Direct Access.
Financial remedy cases can involve ongoing litigation tasks, disclosure management and detailed correspondence. If those tasks are too complex to manage alone, a barrister may recommend solicitor support as well.
Barristers4U can help you request a quote, but the barrister or chambers will decide whether the work is suitable and what scope can be accepted.
Barristers4U helps clients request a quote from a suitable Direct Access barrister. The information on this page is general information only, not legal advice about your individual circumstances.
If your matter is urgent, include hearing dates, court deadlines, orders and any documents you already have when you submit your enquiry.
Direct Access may allow members of the public and organisations to instruct an authorised barrister directly. Suitability depends on the facts, urgency and complexity of the matter. A barrister may decide that a solicitor or another authorised professional is also required.
