Identify The Court Stage And Order Sought

A consent order enquiry should say whether divorce or dissolution proceedings have started, whether a conditional order has been made, whether there is already a financial remedy application and what the proposed order is intended to do.

Consent orders can involve clean break wording, property transfer, sale, pensions, lump sums, maintenance, undertakings and implementation deadlines. This guide is preparation information only.

Documents To Prepare

The first pack should allow a barrister to see the proposed wording and the financial picture behind it.

  • Draft consent order, schedule, undertakings and clean break wording.
  • Form D81, financial statement, asset schedule and income information.
  • Property valuations, mortgage statements, pension cash equivalent values and business documents where relevant.
  • Bank, savings, debt, tax, insurance and investment summaries.
  • Offers, mediation summaries, without-prejudice correspondence where disclosure is appropriate, and agreed heads of terms.
  • Court orders, hearing dates, filing deadlines and implementation dates.

Questions A Barrister May Consider

A barrister may advise on whether the drafting reflects the intended agreement, whether further disclosure is needed, whether court approval issues may arise, or whether a particular clause needs specialist tax, pension or solicitor input.
