Identify The Inaccurate Personal Data
Start with the actual record, screenshot, file note, report, database entry, credit record, employment record, health record or public body record said to be inaccurate or incomplete.
Separate a factual error from a disputed opinion. The evidence needed may be different where the record accurately reports that someone expressed an opinion but the reader disputes the conclusion.
- Copy of the disputed data and where it appears.
- Date the data was created, disclosed or discovered.
- The organisation or controller responsible for the data.
- Documents showing the data is wrong, incomplete or out of date.
- Any linked subject access, erasure, objection or restriction request.
Show The Request And Response Trail
The ICO explains that a request for rectification can be verbal or written. A focused evidence pack should still include written proof of what was requested, when it was made and how the organisation responded.
If the organisation refused, delayed, asked for identity evidence, extended time or proposed a note of dispute instead of changing the data, include those records.
