Solicitors often manage the ongoing conduct of a case, client correspondence, procedural steps, evidence gathering and settlement communications. Barristers are often instructed for specialist advice, drafting, advocacy and representation at hearings.
In many cases the two roles work together. A solicitor prepares and manages the case, and a barrister advises or appears in court where specialist input is needed.
What Direct Access Changes
Direct Access, also called Public Access, may allow you to instruct an authorised barrister directly without first instructing a solicitor. This can be useful when you need a defined piece of advice, drafting or advocacy.
Not all barristers undertake Public Access work, and suitability is assessed case by case. The barrister must be comfortable that the work can be done properly on a Direct Access basis.
When A Solicitor May Be Better First
A solicitor may be the better first step where the case needs intensive day-to-day management, large-scale disclosure, complex correspondence, legal aid assessment, client account handling, or litigation tasks that the barrister cannot accept.
A barrister may also recommend solicitor involvement after reviewing the matter. That recommendation is part of making sure the case is handled properly.
How To Decide What To Ask For
Start with the task, not the job title. Do you need a court advocate, a written opinion, a draft document, settlement advice, urgent hearing representation, or someone to run the whole case from start to finish?
