Short answer

Before requesting a disciplinary hearing barrister quote, gather the disciplinary invite, allegations, investigation report, evidence pack, contract, workplace policies, hearing date, appeal date if any, and a short chronology. If dismissal has already happened, include ACAS and tribunal dates as well.

Core Disciplinary Papers

Start with the documents that show what the employer says happened, what process is being followed and what decision stage has been reached.

  • Disciplinary invite letter and exact allegations.
  • Investigation report, witness notes and evidence pack.
  • Hearing date, appeal date and any postponement correspondence.
  • Disciplinary outcome letter, warning or dismissal letter if already issued.
  • Appeal letter and appeal outcome if the process has moved on.
  • Any settlement, without prejudice or protected conversation correspondence if relevant.

Employment Documents And Workplace Context

Add the documents that explain the role, rules, expectations and previous workplace history.

  • Employment contract, offer letter and later variations.
  • Staff handbook, disciplinary policy and grievance policy.
  • Relevant workplace rules, compliance standards or professional obligations.
  • Previous warnings, appraisals, performance records or absence records.
  • Emails, messages, meeting notes, rota records or system logs connected to the allegations.
  • Names of witnesses and a short note of what each witness can address.

Dates, Deadlines And Tribunal Context

A barrister or chambers will need to understand urgency. Internal deadlines and employment tribunal deadlines are different, and website information cannot calculate your individual time limit.

  • Date of the alleged incident or performance concern.
  • Date of suspension, investigation meeting and disciplinary invite.
  • Date of disciplinary hearing, outcome and appeal deadline.
  • Dismissal date if dismissal has happened.
  • ACAS early conciliation dates and certificate if already started.
  • ET1, ET3, tribunal orders or hearing notices if a tribunal claim exists.

What To Ask The Barrister To Quote For

Define the work as clearly as possible. Direct Access may be suitable for focused advice, document review, drafting or tribunal advocacy, but not every matter can be handled without a solicitor.

  • Advice on evidence and procedural risk before the disciplinary hearing.
  • Review of an appeal, grievance or dismissal response.
  • Advice on settlement, resignation concerns or tribunal risk.
  • Drafting help for defined documents.
  • Representation at a tribunal hearing if the dispute has escalated.
  • A view on whether solicitor support may also be needed.

Important Cautions

This checklist is general preparation information only, not legal advice about whether a disciplinary process is fair or what you should do next.

Submitting a quote request does not pause an internal disciplinary process, appeal date, ACAS deadline, tribunal deadline or court deadline. If time is short, make that clear and continue taking steps to protect your position.

Source/review note: ACAS Code, employment tribunal and workplace procedure points are fact-sensitive. Check current ACAS and tribunal guidance before adding specific deadline or procedure wording.

Disciplinary Hearing Barrister Evidence Checklist FAQs

Should I send every workplace document?

Start with the documents most directly connected to the allegations, policy, dates and outcome. If the bundle is large, explain the approximate page count when requesting a quote.

Can a barrister attend my disciplinary meeting?

Attendance at an internal workplace meeting depends on the employer, contract, policy, professional context and agreed scope. A barrister may instead advise on preparation, evidence or appeal points where suitable.

Do I need ACAS details for a disciplinary issue?

If dismissal or a tribunal claim is possible or has already happened, include ACAS dates and any certificate. Internal disciplinary dates and tribunal deadlines are separate.
