The Short Version

Barristers and solicitors are both legal professionals, but they often do different jobs. A solicitor may manage the whole matter day to day, correspond with the other side, handle procedural steps and instruct a barrister when specialist advocacy or advice is needed.

A barrister is often brought in for specialist advice, drafting, strategy and court or tribunal advocacy. Under Direct Access, some barristers can be instructed directly by members of the public and organisations without a solicitor first instructing them.

The right route depends on the legal issue, urgency, documents, funding, procedural complexity and how much support you need outside the barrister's specific work.

A Barrister May Suit

  • You need specialist advice on a defined legal issue.
  • You need representation at a hearing, court or tribunal.
  • You need drafting, written submissions or a skeleton argument.
  • Your papers are organised and the task is clear.
  • You want a quote for a specific piece of work.

A Solicitor May Suit

  • You need someone to manage the whole case day to day.
  • You need a firm to issue, serve or conduct proceedings.
  • You need client-account handling, settlement funds or undertakings.
  • You need extensive evidence gathering or disclosure support.
  • You may need legal aid or ongoing procedural management.

You May Need Both

  • The solicitor runs the case and instructs a barrister for advocacy.
  • The barrister advises on legal strategy or prospects.
  • The solicitor handles documents, deadlines and correspondence.
  • The barrister represents you at a key hearing.
  • The work is complex enough to need both roles.

How Direct Access Changes The Route

Direct Access, also called Public Access, may allow you to instruct an authorised barrister directly. This can be useful where the work is clearly defined and you can manage the parts of the case that do not need a solicitor.

Direct Access is not a shortcut for every legal problem. A barrister must decide whether they can properly accept the work. If the matter needs a solicitor, the barrister may tell you that before accepting instructions or may recommend solicitor involvement later if the case changes.

Barristers4U helps you request a quote by gathering the practice area, issue, documents, location and deadlines so the enquiry can be routed more effectively.

Important Direct Access Information

Barristers4U helps you request a quote from a suitable Direct Access barrister. We are not a law firm and the information on this website is general information, not legal advice about your individual case.

A Direct Access barrister can often advise, draft documents and represent you in court, but suitability depends on the facts of your matter. Some cases may need a solicitor or another authorised professional, especially where day-to-day conduct of litigation, legal aid or complex procedural support is required.

Any final decision to accept instructions, the scope of work and the fee will be agreed with the barrister or chambers before you proceed.

Official Guidance And Registers

The Bar Standards Board provides public information on using barristers and checking barristers' records. The Solicitors Regulation Authority provides the Solicitors Register for checking solicitors and firms it regulates.

For more information, see the BSB guide on how to hire a barrister, the BSB Public and Licensed Access information, the SRA Solicitors Register and the Law Society guide to legal professionals.

Barrister vs Solicitor FAQs

What is the difference between a barrister and a solicitor?

In general, barristers are specialist advocates and legal advisers, while solicitors often manage ongoing case work, correspondence, client files and procedural steps. The right choice depends on the work needed.

Can I use a barrister without a solicitor?

When might I need a solicitor first?

You may need a solicitor where the case requires ongoing litigation conduct, legal aid, extensive evidence gathering, client-account handling, document service or day-to-day case management.

Can Barristers4U tell me which route is right?

Barristers4U can help you request a quote from a suitable barrister and identify whether Direct Access may be appropriate, but the website does not provide legal advice.
